1. B2B contracting and exclusion of consumer withdrawal rights
AgriGlobal Market services are contracted exclusively by legal entities, commercial entities or agri-food professionals. Consequently, the 14-day right of withdrawal applicable to consumers under Directive 2011/83/EU does not apply.
Consumer carve-out. Where, notwithstanding the foregoing, a person contracts the Services as a consumer within the meaning of Directive 2011/83/EU or the UK Consumer Contracts Regulations 2013, the statutory fourteen (14) day right of withdrawal applies to that contract and prevails over this Section, in the terms set out in the "Right of withdrawal (EU/UK consumers)" section of the Terms of Use.
2. Grace period and subscription cancellation
- 15-day refund window: refund requests may be made within fifteen (15) calendar days following the purchase date of an annual membership. Approved requests are refunded in full to the original payment method.
- No refunds thereafter: once the 15-day window has elapsed, annual subscription fees paid are non-refundable, and access to the platform remains active until the end of the billed annual period.
- Cancellation of renewal: to prevent automatic renewal, the Customer must notify AgriGlobal Market at least fifteen (15) calendar days before the membership expiration date.
- Single Chart purchases: purchases of access to individual charts ($499/year) provide immediate and irrevocable digital access and therefore do not admit cancellation or refund once viewing has been enabled.
3. Pro-rata calculation and refund execution
This Section explains how refund amounts are calculated and paid. It supplements, and does not replace, the fifteen (15) day refund window described in the preceding Section.
Annual subscriptions. If you cancel an annual subscription within the fifteen (15) day refund window, you receive a full refund of the annual fee. If you cancel outside that window, your subscription remains active until the end of the paid period and no pro-rata refund of the remaining period is due, unless a mandatory local consumer law provides otherwise or AgriGlobal Market elects to grant one as a commercial decision. Where the Services are performed in full before the end of a statutory withdrawal period with your prior express consent and your acknowledgment that you lose the right of withdrawal once the service has been fully performed (Art. 16(a) in conjunction with Art. 14(4)(a) of Directive 2011/83/EU), no withdrawal refund is due for that fully performed service.
Individual charts and data credits. Unused single-purchase items (individual charts, one-off data credits) may be refunded on a pro-rata basis, calculated as: Refund = Purchase Price x (1 - Units Consumed / Units Purchased).
- Units consumed are counted from AGM entitlement logs at the time the refund request is received.
- The result is rounded down to the nearest US$ 0.01.
- Partially redeemed bundles are refundable only for the unredeemed balance; promotional or bonus credits carry no cash value and are excluded from the calculation.
- No refund is issued where the calculated amount is less than US$ 1.00 (payment-processing cost threshold).
Execution. Approved refunds are credited within seven (7) to ten (10) business days to the original payment method processed through our payment provider (Stripe). Card-issuer or bank posting times may add a small delay beyond our control. AGM bears all refund transaction fees and never charges restocking or cancellation fees. You will receive a written confirmation by email once the refund has been submitted.
4. Billing and payment disputes
Commercial invoices are issued immediately upon payment confirmation and are available for download in the corporate panel. In the event of a discrepancy in charges invoiced, the Customer must notify [email protected] within thirty (30) days of the charge date for investigation.
